USA: EB-3 Visa Requirements & Application Process
The EB-3 visa is a third-preference employment-based green card for skilled, professional, or other workers. It is one of the five preference categories for employment-based visas and less stringent than the EB-1 and EB-2 categories.
There are three subcategories of the EB-3 visa:
EB-3 skilled workers: This category is for workers with at least two years of training or experience in a skilled occupation. The training or experience must be specific to the occupation, and it can be acquired through education, on-the-job training, or a combination of both.
EB-3 professionals: This category is for workers who hold a U.S. bachelor’s degree or a foreign equivalent and who are employed in a professional occupation. A professional occupation requires a high level of education and training, and it typically involves the exercise of discretion and independent judgment.
EB-3 other workers: This category is for workers who do not qualify for the skilled or professional categories. To qualify for this category, the worker must be performing work for which qualified workers are not available in the United States.
Visa Requirements
- Skilled: two years of training, experience, or job education (sometimes relevant post-secondary education)
- Professional: Baccalaureate degree or equivalent
- Other/Unskilled: or in some cases less than two years of training or experience
(Excludes jobs of a temporary or seasonal nature) - Full-time job offer
Application Process
Employers file Form I-140 Petition for Alien Worker on the applicant’s behalf. Employers must prove their continuing ability to pay the offered wage as current with the priority date. An annual report, federal income tax return, or an audited financial statement is acceptable evidence. The process for applying for an EB-3 visa is complex and can take several years.
